DibsYourTack (DYT) – Terms of Service

Important: DYT is an online advertising and messaging venue only. DYT does not process payments, hold funds, provide escrow, arrange delivery, or verify items/users. Any deal (including price, payment method, delivery/collection, and warranties) is strictly between users and happens off-platform.


1. Interpretation and definitions

1.1 Interpretation

Words with capital letters have meanings defined below.

1.2 Definitions

  • Account: a registered user account on DYT.
  • Content: any text, photos, video, links, messages, listings, profile information, or other material submitted to DYT.
  • Listing / Advert: an advertisement posted by a user for an item or service.
  • Message Centre: DYT’s built-in messaging/forum features that allow users to communicate.
  • Service: the DYT website and related features we provide.
  • User / You: any visitor or registered account holder.
  • Business User / Trader: a user acting for purposes relating to their trade, business, craft, or profession (rather than as a private individual).
  • Consumer: a user acting for purposes outside their trade, business, craft, or profession.

3. Acceptance of these Terms

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


4. Eligibility

You must be at least 18 years old to create an Account and use the Service as a registered user.


5. Accounts and security

  1. You are responsible for all activity on your Account and for keeping your login details secure.
  2. You must provide accurate information and keep it up to date.
  3. You must not create multiple accounts to evade moderation or enforcement actions.
  4. We may suspend or terminate Accounts to enforce these Terms or to protect users and the Service.

6. What DYT does (and does not do)

6.1 DYT is a venue only

DYT provides a place for users to post Listings and communicate via the Message Centre. We are not a party to any user-to-user transaction.

6.2 No payments, escrow, or delivery

  • DYT does not collect, process, or handle money.
  • DYT does not provide escrow or buyer/seller protection.
  • DYT does not arrange shipping, delivery, collection, inspections, or authentication.
  • Any payment and delivery arrangements are outside the scope of DYT and are made directly between users.

6.3 Messaging does not complete a contract

The Message Centre is intended to facilitate communication only. Any binding agreement (if any) is formed directly between users, outside DYT.


7. User content, listings, and conduct

7.1 You are responsible for your Content

You remain fully responsible for your Content and for complying with all applicable laws and regulations (including consumer, product safety, advertising, and intellectual property laws).

7.2 Listing standards (accuracy and clarity)

When posting a Listing, you must:

  • describe items honestly and accurately (including condition, sizing, known defects, and any relevant safety information);
  • use your own photos or photos you have permission to use;
  • list items in the correct category and avoid misleading keywords;
  • set a clear price (or state “free” / “open to offers” where applicable);
  • not post duplicates or spam.

7.2.1 Pricing and currency

  • Listings should state a clear price (or “free” / “open to offers”).
  • Listings should be priced in Euro (€).
  • We may apply maximum listing values (by category) from time to time to support safety and consistency. Listings above any published limits may be rejected, removed, or subject to manual review. (If your item legitimately exceeds a published limit, contact us before posting.)

7.3 Prohibited behaviour

You must not use the Service to:

  • harass, stalk, threaten, defame, or discriminate against others;
  • post hateful, abusive, obscene, or unlawful Content;
  • impersonate others or misrepresent your identity, location, or ownership of goods;
  • share personal data of others without permission (including doxxing);
  • attempt to circumvent moderation or enforcement actions;
  • upload malware, scrape data, or interfere with the Service.

7.4 Prohibited or restricted items

You must not List or solicit:

  • illegal goods or services;
  • stolen goods or goods you do not have the right to sell;
  • counterfeit items or items that infringe intellectual property;
  • unsafe items, recalled items, or items prohibited by law (including applicable animal welfare, veterinary medicine, and controlled substances rules);
  • weapons or any other items that are unlawful or inappropriate for the Service.

DYT may maintain additional “House Rules” or “Prohibited Items” guidance on the site. Those rules form part of these Terms.

7.5 Safety and scams

DYT cannot guarantee the identity, legitimacy, or intentions of users. You should:

  • meet in safe public places where possible;
  • inspect items carefully before paying;
  • be cautious about advance payments, unusual payment requests, or pressure tactics;
  • report suspicious activity to us.

8. Messaging, privacy, and communications

  1. You agree to communicate respectfully and lawfully via the Message Centre.
  2. We may store and process messages to operate the Service, enforce these Terms, and keep users safe.
  3. Your use of the Service is also governed by our Privacy Policy and Cookie Policy (as published on the site).

9. Intellectual property and your licence to us

  1. The Service (excluding user Content) is owned by or licensed to DYT and protected by intellectual property laws.
  2. By submitting Content, you grant DYT a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute that Content only as needed to operate, market, and improve the Service (including showing your Listing to other users).
  3. You represent that you have the rights needed to grant this licence.

9A. Feedback

If you provide suggestions, ideas, or feedback about DYT, you agree that we may use it without restriction or compensation, and you grant us a perpetual, worldwide, royalty-free licence to do so.

10. Moderation, removals, and enforcement

10.1 Our right to moderate

We may review, restrict, remove, or disable access to Content or Accounts at any time to:

  • enforce these Terms and any site rules;
  • comply with legal obligations;
  • protect users and the integrity of the Service.

We are not required to pre-screen Content and do not guarantee that all Content is accurate or lawful.

10.2 Consequences

Enforcement actions may include:

  • warning notices;
  • editing/hiding/removing Listings or Content;
  • temporary or permanent Account suspension;
  • limiting features (e.g., messaging) where appropriate.

10A. Content backups

We may perform regular backups for operational reasons, but we do not guarantee that there will be no loss or corruption of data. You should keep your own copies of Listings, photos, and any other Content you care about.

10B. Intellectual property complaints (copyright/trademark)

If you believe Content on DYT infringes your copyright or other intellectual property rights, please email info@dibsyourtack.com and include:

  • a link (URL) or Listing ID of the allegedly infringing Content;
  • a description of the work/right you believe is being infringed;
  • why you believe it is infringing;
  • your name and contact details; and
  • (where relevant) evidence of your rights or authority to act.

We may remove or disable access to the Content and may contact the uploader for clarification. If you knowingly make a false report, you may be liable for damages.

11. Digital Services Act (DSA) – notice and action, and appeals

DYT acts as a hosting service for user Content. If you believe Content on DYT is illegal, you may submit a notice to info@dibsyourtack.com.

11.1 What to include in a notice

To help us act quickly, include:

  • the URL or Listing ID (or clear location) of the Content;
  • why you believe it is illegal (law/regulation if known);
  • supporting details/evidence (screenshots, links, etc.);
  • your name and contact email.

11.2 What we do

We may:

  • remove or disable access to the Content;
  • request further information;
  • take action against Accounts involved where appropriate.

11.3 Appeals

If we remove Content or restrict an Account, you can appeal by emailing info@dibsyourtack.com with:

  • the relevant Listing ID/username;
  • why you believe the action was incorrect;
  • any supporting information.

We will review the appeal and respond within a reasonable time.


12. Disputes between users

Because DYT does not handle transactions, all disputes about items, payments, delivery, condition, returns, or refunds are between users. DYT is not responsible for resolving user-to-user disputes, though we may take moderation action based on credible reports.


13. Disclaimers

13.1 “As is”

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

13.2 No endorsement or verification

DYT does not endorse or verify users, Listings, or items. Any reliance on Content is at your own risk.

13.3 Links to third-party websites

The Service may contain links to third-party websites or services. We do not control and are not responsible for their content, privacy policies, or practices.


14. Limitation of liability

To the maximum extent permitted by law:

  1. DYT will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses.
  2. DYT will not be liable for user-to-user dealings, including fraud, misrepresentation, or disputes.
  3. Our total liability for any claim relating to the Service will not exceed €100 (unless a higher amount is required by applicable law).

Nothing in these Terms limits liability that cannot be excluded under law (for example, liability for death or personal injury caused by negligence, where applicable).


15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or users.


16. Business users (traders)

If you use DYT as a Business User/Trader:

  1. You must clearly identify yourself as a trader in your profile and Listings where required by law.
  2. You must comply with all applicable laws (including consumer protection and distance selling rules where relevant).
  3. Ranking/ordering: Unless stated otherwise in the interface, Listings are generally presented based on relevance signals such as category match, text match, and recency. We may test or adjust ranking to improve user experience.

You can submit Business User complaints relating to access, suspension, or ranking issues to info@dibsyourtack.com.


17. Governing law and jurisdiction

These Terms are governed by the laws of Ireland. The Irish courts will have jurisdiction, subject to any mandatory consumer protection rules that apply.


18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on the site and update the “Last updated” date. Where changes are material, we will try to give at least 14 days’ notice where reasonably possible. Your continued use of the Service after changes means you accept the updated Terms.


19. Miscellaneous

Language: If we provide a translation, the English version will prevail in the event of a conflict.

Severability: If any part of these Terms is found invalid, the remaining parts remain in effect.

No waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.

Assignment: You may not assign your rights under these Terms without our consent; we may assign ours as part of a business transfer.
